GTRS AC User agreement
Please carefully read and understand all rights and restrictions stipulated in the user license agreement (hereinafter referred to as "this Agreement") before using this product.
ShenZhen MOOER Audio (hereinafter referred to as "we") respect and will strictly protect the legitimate rights and interests (including user privacy, user data, etc.) of users when using GTRS AC (hereinafter referred to as "this product"). In order to provide you with more accurate and personalized services, this product will use and disclose your personal information in accordance with our privacy policy. Unless otherwise specified in this privacy policy, this product will not disclose this information to the public or provide it to a third party without your prior permission.
This user agreement and privacy policy is the final, complete and exclusive agreement between the user (including the natural person, legal person or other organization that obtains this product through various legal channels, hereinafter referred to as "user" or "you") and us on matters related to this product, and replaces and merges the discussion and agreement on the above matters between the parties before the merger.
This agreement will be legally binding on the user's use of this product. Users who start using this product will be deemed to have accepted this agreement. Please carefully read and understand the various terms of this agreement, including the user's use right. If you can't accept all the terms of this agreement, please don't start using this product. If the user is a natural person under the age of 18, please read this agreement accompanied by the legal guardian.
End user protocol
You must use this product legally:
This product will retain or terminate your account in accordance with the provisions of "modification and termination" of this agreement. You are not responsible for your use of this account and your behavior with others. You must notify the product of any unauthorized use or suspected unauthorized use that may violate the law at the first time. This product will not be liable for any loss caused by your failure to comply with the above requirements.
User permissions:
You have the right to use this product, that is, the right to download, install and use this product on your network communication equipment, computer equipment and mobile communication equipment.
In order to use the functions of our software normally, you need to turn on specific access rights in the device. For example:
1. When you turn on the Bluetooth function of the device, you allow our software to obtain the permission of Bluetooth device connection, so that you can synchronize data, transmit data and apply data files to our supporting devices;
2. After you open our file read-write permission, we can read the preset files on your device so that you can upload the preset files to our cloud and download and save the shared data in the cloud;
3. After you open the photo album and the camera (camera) permission, you can read the contents of the photo album and change the avatar; You can obtain the permission to use the camera, shoot and record videos and save them to the album;
4. After you open the geographical location permission, you allow us to obtain your device location information, so that we can provide you with more suitable page display, information interaction and accurate location of nearby Bluetooth devices;
5. After you open the network connection permission, you allow us to obtain the network connection, so that you can register your account online, log in to your account, and use the cloud sharing and downloading functions of our equipment;
6. After you turn on the microphone and related voice permissions, you can use the microphone to record audio files.
Your authorization will be subject to the following restrictions:
1. You cannot license, sell, lease, transfer, distribute or use this product for other commercial purposes in any form;
2. Unless such restrictions are prohibited by law, you cannot modify, translate, adapt, merge, utilize, decompose, transform or reverse compile, reverse engineer, etc. any part of this product or derivative products;
3. You shall not use this product for the purpose of creating the same or competitive services;
4. Unless expressly provided by law, you cannot produce, copy, distribute, sell, download or display any part of this product in any form or method;
5. You cannot delete or destroy any copyright notice or other ownership mark contained in this product.
User content
You are the only person responsible for your user content, and you will bear the risk that you or any third party will be identified due to the disclosure of your user content. User content refers to all content generated when the user downloads, publishes or otherwise uses the product (e.g. your information, pictures, music, files or other content).
You have agreed that your user content is subject to rights restrictions, and you have agreed to use relevant services in this product through sharing or other means. You have agreed to use the relevant services in this product through sharing or other means. In the process of use, you will bear all legal liabilities arising from the risks caused by the following acts:
1. Undermining the basic principles established in the constitution;
2. Endangering national security, divulging state secrets, subverting state power and undermining national unity;
3. Harming the honor and interests of the state;

5. Those who undermine the state's religious policies and promote cults and feudal Superstitions;
6. Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crime;
7. Insulting or slandering others and infringing upon the legitimate rights and interests of others;
8. Containing other contents prohibited by laws and administrative regulations.
You have agreed not to engage in the following acts in this product:
1. Release or share computer viruses, worms, malicious code, and software that deliberately destroys or changes computer systems or data;
2. Collect information or data of other users without authorization, such as e-mail address, etc;
3. Maliciously use this product in an automatic way, causing excessive burden to the server or interfering with or damaging the website server and network links in other ways;
4. Attempt to access the server data or communication data of this product without authorization; Interfere with and destroy the use of other users of this product.
Disclaimer
Users should pay attention to the correct use of our products, equipment and services during use:
In order to ensure the correctness of the sampling results and avoid damage to the equipment, please connect the equipment in strict accordance with the equipment connection diagram. ShenZhen MOOER Audio will not bear corresponding responsibility for the equipment damage caused by improper equipment connection.
The test signal will be sent automatically during the sampling process. In order to avoid damage to the equipment and users' hearing caused by excessive volume, please turn down the equipment volume before sampling, and then adjust it to the appropriate volume level according to the tips of the sampling process. ShenZhen MOOER Audio shall not be liable for equipment and physical damage caused by improper operation.
You guarantee that the files uploaded to MOOER CLOUD do not have legal problems such as infringement, and ShenZhen MOOER Audio will not bear legal liabilities caused by infringement of file contents or other problems. When you upload a file to MOOER CLOUD (without signing other agreements), you agree that ShenZhen MOOER Audio have the right to use the file by default. ShenZhen MOOER Audio has the right to use, disseminate, copy, modify, sublicense, publicize and promote the files you upload.
If a legal dispute arises over the content of the uploaded file and causes losses to tShenZhen MOOER Audio, ShenZhen MOOER Audio has the right to require the user to compensate for the losses incurred, including but not limited to economic losses, administrative fines, settlement funds for dispute settlement, compensation, litigation costs, etc.
You have agreed to use the product innocuously and avoid any complaint, lawsuit, loss, damage, liability, cost and expense (including lawyer's fee) from a third party due to the following acts or related acts:
1. User's behavior of using this product;
2. User content of the user;
3. The user violates this Agreement;
4. We reserve the exclusive right of defense and claim for compensation.
You have agreed that you cannot settle unilaterally in a lawsuit brought by you and us against a third party unless you obtain our written consent. Under no circumstances shall this product be liable for any indirect, consequential, punitive, incidental, special or punitive damages incurred by you or any third party due to this agreement. The risk of damaging computer system or mobile communication equipment data caused by accessing and using this product will be borne by you personally.
This Agreement shall be governed by the laws of the people's Republic of China; In case of any dispute between both parties, it shall be settled through friendly negotiation; If the negotiation fails, a lawsuit shall be filed with the local court.
About third party services
You know or agree that some of our services are obtained based on the technical support of a third party; You know that this agreement is signed before you and us, not between you and the above-mentioned third party. We are the sole responsible person for the content, maintenance, support services, guarantees and litigation arising from this product.
You have agreed to abide by and authorize this product to restrict your conditional use of the services of this product:
1. This product contains some information and services from third parties.
2. We do not control and are not responsible for the information and services of third parties;
3. Users shall bear legal liability for the risks arising from the use of third-party information and services;
4. When users access third-party information and services, the terms and policies of the third party shall apply.
Change and termination
We have the right to retain or terminate your account in accordance with the provisions of "change and termination" of this agreement. You shall promise to keep your login information confidential, not to be obtained and used by others, and be responsible for all your actions under this account. You must inform us of any unauthorized use or suspected unauthorized use that may violate the law at the first time. This product will not be liable for any loss caused by your failure to comply with the above requirements.
GTRS ACPrivacy Policy
GTRS AC is an application developed by ShenZhen MOOER Audio Co., Ltd. (hereinafter referred to as " this application "). We respect and protect the personal privacy of all users (you) using the service. In order to provide you with more accurate and personalized services, this application will use and disclose your personal information in accordance with the provisions of this privacy clause. However, this application will treat this information with a high degree of diligence and prudence.
Unless otherwise specified in this privacy clause, this application will not disclose this information to the public or provide it to a third party without your prior permission. This application will update the privacy terms from time to time. When you agree to this application service use agreement, you shall be deemed to have agreed to all the contents of this privacy clause. The privacy terms are an integral part of this application service use agreement.
Please carefully read, understand and agree to the GTRS AC privacy terms before using GTRS AC application. This clause specifies how we will collect, use, disclose, process and protect the information you provide us when you use the Travel Research Society application. If we need you to provide certain information to verify your identity when using the product and connect to our third-party service provider, we will strictly abide by the privacy terms to use this information. If you have started using the Travel Research Society application, it means that you have read, approved and accepted all the terms described in the privacy terms, as well as any changes we may make from time to time in the future.
We will, in accordance with the relevant laws and regulations mentioned in the introduction, follow the principles of legitimacy, legality and necessity, and collect and use your personal information actively provided by you in the process of using this application, arising from your use of this application and obtained by us from a third party for the following purposes described in this clause.
No matter which of the above scenarios is used to collect and use your personal information, we will usually only do so with your consent, unless in some cases, we collect personal information from you based on legal obligations or may need to protect the important interests of you or others.
Please understand that due to the change of business strategy, the functions of this application may also be changed and developed. If we want to use your personal information for other purposes not specified in this clause, or the personal information collected for specific purposes will be used for other purposes, we will inform you in a reasonable way through this platform and obtain your consent again before using.
1. In order to realize the basic business functions of this application, we may need to collect and use your relevant personal information. The following will detail our basic business functions and the types of personal information required to realize this function. If you refuse to provide it, you will not be able to use the relevant products and / or services of this platform.
(1) Log information: in order to ensure your account security and system operation security, we will automatically collect the details of your use of the application and / or website related services and save them as a network log, including Internet Protocol (IP) address, device terminal operating system, device terminal identifier, Internet service provider (ISP), date / time stamp and click data stream, to judge your account risk, ensure that the application provides you with normal services, count traffic, troubleshoot abnormal information, and detect, prevent and investigate fraud, abuse or security incidents.
2. In order to realize the business function of this application, we may need to collect and use your relevant personal information. The following will detail our basic business functions and the types of information necessary to realize this function. The collection and use of these personal information will only be carried out on the premise that you have confirmed your consent.
（(1) Registration / login: when you register / login, you may need to provide us with mobile phone number, email address and other information so that we can communicate with you about the use of this application. At the same time, we will collect your "device information" to identify unique users and detect and prevent fraud.
(2) In this process, we will need your authorization to open "network access permission", and open "read / write SD card permission" when you need to upload / download pictures.
3) Push: we will push excellent content to you from time to time. This function is provided by the aurora SDK. See Appendix II for its privacy terms.
Please note and know that in order to realize the above business functions, the application collects your "device information", "read and write SD card permission", "access calendar", "display floating window", "resident notice", "network access" and "clipboard information", on the premise that you are authorized to open "device information permission", "read and write SD card permission" and "access calendar permission" "Display floating window permission", "resident notification permission", "network access permission", "access and write clipboard permission". If you don't want to collect the above information, you can turn off "device information permission", "read and write SD card permission", "access calendar permission", "display floating window permission", "resident notification permission", "network access permission" and "access and write clipboard permission".
We promise that we will never collect or require you to provide personal sensitive information, including but not limited to personal race, political orientation, religion, belief, personal genetic data or biometric data, sexual orientation and so on.

1、 Use of information
1. The app will not provide, sell, rent, share or trade your personal information to any irrelevant third party, unless you have obtained your permission in advance, or the third party and the app (including the app's affiliates) provide services for you alone or jointly, and after the end of the service, it will be prohibited from accessing all these materials, including those it can access before.
2. This application also does not allow any third party to collect, edit, sell or disseminate your personal information free of charge by any means. If any user of the application platform engages in the above activities, once found, the application has the right to immediately terminate the service agreement with the user.
3. For the purpose of serving users, the app may provide you with information you are interested in by using your personal information, including but not limited to sending you product and service information, or sharing information with app partners so that they can send you information about their products and services (the latter requires your prior consent).

6. If you are a qualified intellectual property complainant and have filed a complaint, you should disclose it to the respondent at the request of the respondent, so that both parties can deal with possible rights disputes;
7. The information collected is disclosed to the public by yourself;
8. Necessary for maintaining the safe and stable operation of software and related services, such as finding and handling faults of software and related services;
9. Other disclosures that the application deems appropriate in accordance with laws, regulations or website policies.
4、 Information storage and exchange
1. The information and materials about you collected by this app will be saved on the servers of this app and / or its affiliates in the people's Republic of China. These information and materials may be transmitted to your country, region or overseas where this app collects information and materials, and accessed, stored and displayed overseas.
2. We only store your and / or end-user's personal information for the purpose stated in this clause and the shortest period specified by laws and regulations. After exceeding the storage period, we will delete or anonymize your personal information. However, in order to comply with the corresponding laws and regulations, we may extend the storage period of your personal information and / or your end users for the purpose of litigation defense, safeguarding the public interest, protecting the safety of personal property or legal rights.

You have the right to access your personal information, except for exceptions provided by laws and regulations. If you want to exercise data access, for example, you want to access or edit your profile information in your account, change your password, bound email, mobile phone number and social media account, you can do so by visiting the user center.
If you cannot access these personal information through the above, you can use the user feedback function in the application to exercise data access. We may ask you to verify your identity when you access the relevant information.
Please understand that some of your requests may not be able to respond due to technical constraints and legal and regulatory requirements. Some of your information may not be accessible due to legitimate reasons such as legal and regulatory requirements and ensuring information security.
In any of the following cases, you can request to delete the personal information provided by you through the user feedback function in this application:

3. Cancellation of account
You can log off your previously registered account at any time. You can log off your account through the function of in app feedback - > feedback account problems. You should know that cancelling your account will cause you to permanently lose access to your account and the data in your account. We will provide you with account cancellation service after verifying your identity.
4. Respond to your above request
To ensure security, we may require you to verify your identity before processing your request. You may need to provide a written request or otherwise prove your identity. For all your requests under this section, in principle, we will give feedback within 15 days after receiving your request and verifying your user identity.

This application will ensure that your information will not be lost, abused or altered by encrypting user passwords and other security measures. Despite the above security measures, please note that there are no "perfect security measures" on the information network. The Internet is not an absolutely secure environment, and e-mail, instant messaging and communication with other users are not encrypted. We strongly recommend that you do not send personal information in this way. Please use complex passwords and change them regularly to help us ensure the security of your account.
4. When using this application network service to conduct online transactions, you will inevitably disclose your personal information, such as contact information or postal address, to the counterparty or potential counterparty. Please protect your personal information properly and provide it to others only when necessary. If you find that your personal information is leaked, especially the user name and password of this application, please contact the customer service of this application immediately so that this application can take corresponding measures.
We reserve the right to update this statement at any time. When the statement is modified, we will inform you of the changed statement through pop-up window or notice.
